The use of this site is governed by the policies, terms and conditions as set forth below. Please read over them carefully before using this site or entering data or donating. Your use of this site indicates your acceptance of these terms and conditions. Your donation, in person or through mail or through this site, directly or indirectly, through one of the payment gateway service providers of EEGAN, indicates your acceptance of these terms and conditions. These terms and conditions prevail unless otherwise stated differently in any other donation related agreement between EEGAN and you.
2. Right of Modifications of Policies
EEGAN reserves the right to add or modify or delete its policies and/or operating procedures, partially or totally, at any time, at its sole discretion, without notice.
3. Currency of Transaction
EEGAN accepts donations in all legal currencies and instruments from all countries. If your donation currency is other than the United States Dollars (USD), EEGAN or its payment gateway may convert the amount in USD and EEGAN will send a receipt showing the amount in the currency of your donation or USD. All transactions in this site are in USD. If a dollar amount is shown with “$” sign anywhere in this website, it denotes USD.
4. Payment methods for Donations
For your convenience, the following methods of donations are accepted:
(a) Credit cards: American Express, Mastercard, Visa and Discover Network card and any other credit cards that are being accepted by the payment gateway service providers of EEGAN at the time of your donation. The current payment gateways are Google Checkout™ and PayPal™. EEGAN does NOT handle and does NOT store and does NOT have access to your credit card information. Minimum donation amount, through any of the payment gateways, is $1.
(b) Cash: Cash should be handed over, in person, only to an authorized EEGAN representative. Cash is NOT accepted from or through this website.
(c) Checks: Personal check or cashier’s check made payable to EEGAN INC. Checks are NOT accepted directly from or through this website. Please hand over the check, in person, to an authorized EEGAN representative or mail it.
(d) EEGAN also accepts bequests, devises, transfers or gifts.
5. Receipts for Donations
(a) EEGAN does NOT provide any receipt for anonymous donations.
(b) EEGAN acknowledges and provides receipts for every completed transaction of non-anonymous donation. A receipt is sent through electronic mail. If an electronic mail address is not provided by the donor or is found to be invalid, a printed receipt will be mailed to the address provided by the donor through the First Class mail of the United States Postal Service. A non-anonymous donation transaction is deemed complete and a receipt is sent to the address of the donor, depending on the payment method, as follows:
(i) Credit cards: When the transaction is cleared by the payment gateway and the fund is deposited into EEGAN’s bank account. EEGAN will NOT provide any receipt for a failed transaction of credit card.
(ii) Cash: The date of transaction.
(iii) Checks: When the check is cleared by the corresponding bank(s) and the fund is deposited into EEGAN’s bank account. For any dishonored or bounced check, EEGAN will NOT provide any receipt for such donation and EEGAN will invoice the donor for an amount equivalent to the amount charged by the bank plus the postal charges and that invoice needs to be paid immediately upon receipt.
(c) The date of donation shown on the receipt varies, according to the payment method, as follows:
(i) Credit cards: The date the transaction was initiated through payment gateway.
(ii) Cash: The date cash was handed over to an authorized EEGAN representative.
(iii) Checks: The date the check was handed over to an authorized EEGAN representative or the date postal mail with the check was received at EEGAN.
(d) For bequests, devises, transfers or gifts, EEGAN acknowledges and provides receipts when such a transaction is completed by the donor AND EEGAN legally holds the donation in possession.
(e) EEGAN reserves the right to cancel any receipt issued by EEGAN, if the donation was found to be illegal and/or not realizable/usable by EEGAN. Such a cancellation may result in legal action, including but not limited to, prosecuting the donor to the fullest extent permitted by law and informing Internal Revenue Service (IRS) and/or the law enforcement officials. In such a case, EEGAN will release all information about such donation(s) and the donor(s) involved, to the law enforcement officials and fully co-operate with the law enforcement.
(a) All donations to EEGAN are final and are not refundable.
(b) If there is an error in your donation transaction through one of the payment gateways initiated on this website, you agree to write to EEGAN with all details of your donation through electronic mail or postal mail so that EEGAN receives such information within SIXTY (60) days from the date of donation. EEGAN will NOT provide any refund after SIXTY (60) days from the date of donation. If EEGAN has not already spent your donation(s), EEGAN will verify the information provided by you with the payment gateway service provider and if the information is found to be correct, EEGAN will refund an amount that equals the ACTUAL amount received by EEGAN which is the donation amount minus the transaction charges levied by the payment gateway service provider.
7. Donations towards Favorite Projects
Donations to EEGAN are pooled under individual projects according to the favorite project specified by the donor, in addition to, the General Donation pool. If a donor has not chosen any favorite project or has chosen “Any Eegan project”, such a donation is pooled under the General Donation. Funds under the General Donation pool are used to support any project and/or administrative costs, including but not limited to, website hosting charges, mailing charges and any fees levied by any Government agency from time to time. If a project is decommissioned, then the funds pooled under that project are released to the General Donation pool for subsequent use. If the General Donation pool has insufficient funds to handle administrative costs, then sufficient funds are transferred from individual project pools to the General Donation pool to meet the demand.
8. Tax Deductibility
EEGAN is a 501(c)(3) not-for-profit public charity. All donations towards EEGAN are tax deductible to the extent permitted by law. EEGAN does not provide tax advice on any donation and does not provide any advice on impact of a donation on taxes. You agree to consult a qualified accountant and/or guidelines of Internal Revenue Service (IRS) to assess your tax situation in connection with your donation to EEGAN.
9. Privacy and Security
EEGAN does NOT share or sell any personally identifiable information about you with any third party. If you are using any payment gateways of EEGAN to donate, you are providing information about you to those third-party gateway websites directly and not to EEGAN. These gateways may provide you the facility to remain anonymous to EEGAN.
11. Legal Notices
Under no circumstances shall EEGAN or its officers or its employees or its contractors or its sub-contractors or its volunteers be liable for any indirect, special, incidental or consequential damages of any kind, regardless of the form of action, whether in contract, tort (including negligence), strict product liability or otherwise, even if EEGAN has been advised of the possibility of such damages. 12. Disclaimer and Limitation of Liability
This web site and the information about services/projects therein are provided on an "as is" basis. EEGAN makes no representations or warranties, either express or implied, of any kind with respect to this site, its operation, contents, information and/or materials. EEGAN hereby expressly disclaims all representations, conditions, and/or warranties, either express or implied, of any kind, with respect to this site and/or its use, including but not limited to any implied warranties or conditions of merchantability and/or fitness for a particular purpose. You agree that EEGAN shall not be liable for any and/or all damages arising from the operation, content and/or use of this site and/or the payment gateways EEGAN uses to process transactions. You further agree that this limitation of liability is comprehensive and applies to all damages of any kind, including but not limited to direct, indirect, special, punitive, compensatory, incidental and/or consequential damages for lost profits, lost sales, loss of income, loss of time, inconvenience, loss of use or inability to use, loss of bargain, injury to person and/or property, labor, disappearance, non-delivery or delay of any shipment, and/or any other direct, indirect, special, punitive, compensatory, incidental, and/or consequential damages, conditions and/or losses of any kind, no matter whether based upon warranty, contract, negligence, misuse and/or any other causes.
